Concerns are growing in the international community regarding China’s “Patriotic Education/Ethnic Unity Promotion Law,” which takes effect on July 1st. The law allows for the punishment of remarks or actions deemed contrary to ethnic unity, and notably, it applies to acts committed outside of China as well. With the Ministry of Justice emphasizing the legitimacy of this “extraterritorial application” ahead of the enforcement, it seems clear the goal is to stifle free speech.
“This will not affect normal activities such as cultural exchange, academic discussions, or economic and trade cooperation abroad,” Vice Minister Hu Weilie emphasized at a press conference held one week before the law goes into effect.
The Ethnic Unity Law, aimed at the spiritual integration of China’s 56 ethnic groups, mandates the prioritization of standard Chinese language education. It not only encourages citizens to report violations but also explicitly states that it will “pursue legal responsibility for foreign organizations and individuals.” Media outlets and human rights groups have raised concerns that this could include speech and actions taken in countries like Japan.
In the press conference, Mr. Hu claimed that extraterritorial application is “in line with international law.” However, he failed to explain what would be considered “normal activities,” highlighting the danger of vague definitions and the risk of arbitrary enforcement by authorities.
